These General Terms of Service apply to all users of the Voices Against Violence website (“Website”), and address user conduct and the rights and responsibilities associated with use of the Website.

By using this Website, you agree that you have read, understood and agree to these General Terms of Service.  If you are under 13 years of age, please ask a parent or a legal guardian to read through these Terms of Service and our Online Privacy Policy before you use the website.  If you are under 13 years of age, you will not be able to register on certain areas of the website until your parent or a legal guardian provides us with their written consent.  The Brady Campaign to Prevent Gun Violence (Brady Campaign) and the Brady Center to Prevent Handgun Violence (“The Brady Campaign and Brady Center”) reserves the right, at our discretion to change, modify, add or remove portions of this policy at any time. Please make sure to check this page periodically for any changes.  Your continued use of this Website following the posting of any changes to the General Terms of Service constitutes acceptance of those changes.

You may not reproduce, distribute, republish or retransmit any Content or materials posted by third parties at this Website without the prior written permission of The Brady Campaign and Brady Center.  Except as expressly authorized by The Brady Campaign and Brady Center, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such Content or third party materials.  Notwithstanding the above, you may print or download one copy of the materials or Content on this Website on any single computer for your personal, non-commercial use, provided you keep intact all copyright and other proprietary notices.  Systematic retrieval of data or other Content from this Website to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from The Brady Campaign and Brady Center is prohibited.

8.    VISITOR CONDUCT

11.    REPRESENTATIONS AND WARRANTIES.

You represent, warrant and covenant that:  (a) you or your parent or legal guardian have the power and authority to enter agree to these General Terms of Service; (b) you shall not use any rights granted hereunder for any unlawful purpose; and (c) you shall use this Website only as set forth in these General Terms of Service.

12.    INDEMNITY

You agree to indemnify and hold The Brady Campaign and Brady Center and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys’ fees, made by any third party that arise from your use or misuse of this Website.  The Brady Campaign and Brady Center reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with The Brady Campaign and Brady Center in asserting any available defenses.

13.    INTERNATIONAL USE

The Brady Campaign and Brady Center makes no representation that materials or Content on this Website are appropriate or available for use in locations outside the United States, and accessing them from territories where the Contents or materials are illegal is prohibited.  If you access this Website from other locations you do so on your own initiative and you are responsible for compliance with local laws. You agree to comply will all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

14.   COPYRIGHT POLICY

The Brady Campaign and Brady Center respects the intellectual property rights of others and expects visitors to this Website to do the same. The Brady Campaign and Brady Center will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. The Brady Campaign and Brady Center reserves the right to remove content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, The Brady Campaign and Brady Center will also terminate a user’s account if the user is determined to be a repeat infringer. The Brady Campaign and Brady Center’s designated copyright agent for notice of alleged copyright infringement appearing on the Website is available upon request.

15.    CHOICE OF LAW AND FORUM

These General Terms of Service shall be governed by and construed in accordance with the laws of Washington DC, excluding its conflicts of law rules.  You agree that any dispute arising out of or in connection with these General Terms of Service or your use of this Website shall be fully and finally settled by arbitration, before one arbitrator, in accordance with the most current American Arbitration Association Commercial Dispute Resolution rules.  Such arbitration shall be conducted within Washington DC.  The prevailing party in any such arbitration shall be awarded its attorneys’ fees and all costs associated with such arbitration.  Either party may enter any arbitration award in any court having jurisdiction or may make application to any such court for a judicial acceptance of the award and order of enforcement, as the case may be.  Each party understands and agrees that any infringement of The Brady Campaign and Brady Center intellectual property rights or other use of The Brady Campaign and Brady Center information or materials in violation of any provision of this Agreement will cause The Brady Campaign and Brady Center irreparable harm without an adequate legal remedy.  Notwithstanding the above, The Brady Campaign and Brady Center will, therefore, be entitled to seek injunctive relief from any court having jurisdiction.  You submit to the exclusive jurisdiction of the federal and state courts located in the Washington DC for this purpose

16.    SEVERABILITY AND INTEGRATION

This General Terms of Service constitute the entire agreement between you and The Brady Campaign and Brady Center with respect to this Website and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and The Brady Campaign and Brady Center with respect to this Website.  If any part of these General Terms of Service is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.   You may not assign any of the provisions of these General Terms of Service to any third party without the prior written consent of The Brady Campaign and Brady Center.  These General Terms of Services shall inure to the benefit of the parties and their respective successors and permitted assigns.

18.    TERMINATION

The Brady Campaign and Brady Center reserves the right, in its sole discretion, to terminate your access to all or part of this Website, with or without notice.
